Safety Incident definition

Safety Incident means: (i) a failure by the Supplier or any Subcontractor to comply with any OHS Requirements; or (ii) any hazard, incident or accident caused by the Supplier or a Subcontractor. (hh) “Sales Tax” has the meaning ascribed to such term in Section 16.1;

More Definitions of Safety Incident

Safety Incident means any failure of the Design-Build Firm or any of the Design-Build Firm Parties to safely manage performance of the Design-Build Firm Parties in accordance with Applicable Law and as necessary to recognize and successfully prevent or avoid casualty losses to property and injury or death to persons (each such failure being a Safety Incident), including but not limited to: (a) The reported observation of a potential safety hazard, unsafe work practice, or lapse in prudent safety management that can reasonably be expected to lead to injury or death to any person, or damage to any property; (b) The presence of any unsafe working condition, including without limitation any unauthorized or improper usage of equipment or faulty equipment, that reasonably be expected to lead to injury or death to any person, or damage to any property; or (c) The occurrence of bodily injury or death, or property damage arising out of or in connection with the Project or the performance of the Services and Work.
Safety Incident means any failure of the Architect/Engineer or any of the Architect/Engineer Personnel to manage performance of the Architect/Engineer Personnel as necessary to recognize and successfully prevent or avoid any of the following circumstances (each being a Safety Incident):
