Seller Capital Stock definition

Seller Capital Stock means the Seller Common Stock and the Seller Preferred Stock.

Seller Capital Stock means (i) all shares of common stock of Seller, no par value per share, (ii) all shares of preferred stock of Seller, no par value per share, and (iii) any other capital stock of Seller.

Seller Capital Stock has the meaning set forth in the recitals.

• If the Representative shall be unable or unwilling to serve in such capacity, his successor, who will serve and exercise the powers of the Representative hereunder, will be named by those persons holding a majority of the shares of Seller Capital Stock.
