The Issuer issued the Series 2007 Bonds pursuant to the Original Indenture as amended and supplemented by the Ninth Supplemental Indenture of Trust dated as of November 1, 2007 (the “Ninth Supplemental Indenture”).
To provide funds to make the Loan for purposes of assisting in paying the Project Costs, the Issuer will issue, sell and deliver the Series 2007 Bonds to the Original Purchaser.

The proceeds from the initial sale of the Series 2007 Bonds shall be paid over to the Trustee and deposited as described in Section 2.09 of the First Supplemental Indenture.
