According to the Spanish Insolvency Act, secured creditors are considered privileged creditors (acreedores con privilegio especial) which may initiate separate proceedings, though subject to certain restrictions derived from a waiting period as stated below.
This is primarily due to the fact that the Spanish Insolvency Act was recently subjected to a full reform.
The Spanish insolvency regime is regulated by the Spanish Insolvency Act 22/2003, dated 9 July (the “Insolvency Act”).
In particular, in relation to any Obligor incorporated under the laws of Spain, without prejudice to the above, each of the Subordinated Creditors expressly accepts and acknowledges that any of its claims against such Obligor in respect of the Subordinated Debt shall be deemed as subordinated claims in accordance with article 92.2 of the Spanish Insolvency Act (Ley 22/2003 Concursal).
When the debtor has identified its creditors, the bankruptcy judge notifies them of the start of the procedures and their obligation to make their claims under the agreement with the Spanish Insolvency Act.
