The Supplier shall notify ICTS as soon as reasonably possible of any information of which the Supplier becomes aware which is likely to be relevant to the Status Determination Statement conclusion.
The Supplier shall continue to apply (or procure that the Fee-Payer continues to apply) the Status Determination Statement conclusion in accordance with this clause 18, which has been notified to it in respect of all subsequent payments made to the relevant Limited Company Contractor unless and until ICTS notifies the Supplier that the Status Determination Statement conclusion has changed.
The parties agree that, for the purposes of any statutory or other obligation on ICTS to provide information to the Supplier or Fee-Payer and/or the Limited Company Contractor about ICTS' reasons for reaching the Status Determination Statement conclusion it shall suffice that ICTS provides details of the basis on which it approaches making the Status Determination Statement conclusion and that ICTS shall therefore be deemed to have satisfied its obligation to provide such information.
The parties agree that ICTS may use such means of reaching the Status Determination Statement conclusion in relation to any Limited Company Contractor as it shall decide from time to time.
For the avoidance of doubt, this includes any period during which ICTS is re-considering the Status Determination Statement pursuant to clause 18.9 above.
In particular, if the Status Determination Statement issued by Legal & General provides that an Off Payroll Resource is In Scope, the Supplier shall make such deductions of income tax and National Insurance contributions from any payment to the entity through which the Off Payroll Resource has been engaged, and shall make such payment of employer National Insurance contributions and Apprenticeship Levy in respect of such payment, as is required by law.
The Supplier shall continue to apply the Status Determination Statement in respect of all subsequent payments made to the relevant entity through which the Off Payroll Resource is supplied (and, if the Off Payroll Resource supplies the Services via an Intermediary, shall procure that any Intermediary shall also do so), unless notified otherwise by Legal & General.
In the event that the Supplier is not the 'fee-payer' for the purposes of section 61N ITEPA (the "Fee-Payer"), the Supplier shall pass the Status Determination Statement to the Fee-Payer, or to such other person to whom the Supplier makes a chain payment as defined in section 61N ITEPA.
