Subject Acquisition definition

Subject Acquisition means any acquisition by the Borrower and/or any of its Wholly-Owned Subsidiaries of, or any transaction that results in the Borrower and/or any of its Wholly-Owned Subsidiaries owning, whether by purchase, merger, exclusive inbound license, transfer of rights under copyright or otherwise, all or substantially all of the assets of, all of the Equity Interests of, or a business line or unit or a division of, any Person.
Subject Acquisition has the meaning specified in Section 7.10(b).
Subject Acquisition has the meaning assigned such term in Section 9.16(d)(i).

Subject Acquisition means any acquisition or series of related acquisitions by TenFold or any subsidiary of TenFold that it controls or of which it shares control (by any means, including, without limitation, purchase, distribution or merger) of all or a majority of the assets of any business or a controlling interest in the voting securities or other equity interests of any Person where TenFold or its subsidiary seeks to raise cash consideration for use in the acquisition in exchange for an equity interest in the acquired company.
