Subordinated Notes Documents definition

Subordinated Notes Documents means the Subordinated Notes, the Subordinated Notes Indenture and all other material documents executed and delivered with respect to the Subordinated Notes or the Subordinated Notes Indenture, as in effect on the Effective Date and as the same may be modified, supplemented, restated and/or amended from time to time in accordance with the terms hereof and thereof.

Subordinated Notes Documents means the indenture under which any of the Existing Subordinated Notes, the Permitted Subordinated Notes and the Permitted Acquisition Subordinated Notes are issued and all other instruments, agreements and other documents evidencing or governing such Notes or providing for any Guarantee or other right in respect thereof.

Subordinated Notes Documents means the Subordinated Notes, any indentures or other agreements, instruments and other documents pursuant to which the Subordinated Notes or other Subordinated Debt have been or will be issued or otherwise setting forth the terms of the Subordinated Notes or such Subordinated Debt, including guarantees in respect of the Subordinated Debt referred to in clauses (i) and (iii) of the definition of "Subordinated Notes," in each case as such agreement, instrument or other document may be amended, supplemented or otherwise modified from time to time in accordance with the terms thereof, but only to the extent permitted under the terms of the Loan Documents.

Examples of Subordinated Notes Documents in a sentence

• The security interests and liens granted to secure the Reorganized Debtors’ obligations under the New ABL Credit Facility Documents and the Senior Subordinated Notes Documents shall not attach to any real property lease to the extent that the grant of a security interest in such real property lease would violate any enforceable anti-assignment provisions of such lease or violate applicable state law.

• An Officer's Certificate of Borrower, dated the Amendment and Restatement Date, (i) to the effect set forth in clauses (a) and (b) of Section 7.03(i), (ii) to the effect that all conditions precedent to the making of such extension of credit have been satisfied and (iii) to the effect that execution and delivery of this Agreement, and borrowings under this Agreement, do not cause a default or breach under the Senior Subordinated Notes Documents and showing reasonably detailed calculations thereof.

• A physical inventory should be taken of capital assets at least every five years.

Subordinated Notes Documents means the Indenture dated as of February 4, 2004 by and among the Borrower, the guarantors party thereto and U.S. Bank National Association, as trustee, the Subordinated Notes and all other agreements, instruments and other documents pursuant to which the Subordinated Notes have been or will be issued or otherwise setting forth the terms of the Subordinated Notes.

Subordinated Notes Documents means the Subordinated Notes Indenture and each of the other documents, agreements, and instruments (including, without limitation, all collateral documents) executed and delivered from time to time in connection with the Subordinated Notes.

Subordinated Notes Documents means the Indenture, dated as of July 3, 2001, between the Company and State Street Bank and Trust Company of California, N.A., a national banking association, the Subordinated Notes and all other agreements, instruments and other documents pursuant to which the Subordinated Notes have been or will be issued or otherwise setting forth the terms of the Subordinated Notes.

Subordinated Notes Documents means, collectively, the Senior Subordinated Notes, Senior Subordinated Notes Junior Guaranties, Junior Subordinated Notes, and Subordinated Notes Guaranties and "Subordinated Notes Document" shall mean, any of the same, individually."
