Subsequent Warrant definition
Subsequent Warrant means any Note Warrant issued on the Issuance Date and which contains a Vesting Date (as defined therein).
Subsequent Warrant or “Subsequent Warrants” shall mean a warrant or series of warrants to purchase the aggregate number of shares of New Athletics Common Stock determined pursuant to Section 5.2 hereof, if applicable, to be issued to VPVP pursuant to the terms of Section 5.2 hereof, if applicable, which Warrant or Warrants, if issued, shall be executed and delivered in substantially the form attached hereto as Exhibit A.
Subsequent Warrant has the meaning specified in Section 2.3 below.
Examples of Subsequent Warrant in a sentence
The purchase and sale of the Subsequent Warrant (the “Subsequent Warrant Closing”) shall take place on the Subsequent Warrant Closing Date (or the Stock Purchase Commitment Termination Date, if applicable) or such other date mutually agreed upon in writing, subject to the satisfaction or waiver by the party for whose benefit the condition exists of the applicable conditions set forth in Section 3.02 and Section 3.03.
