Subsequent Warrant definition

Subsequent Warrant means any Note Warrant issued on the Issuance Date and which contains a Vesting Date (as defined therein).
Subsequent Warrant or “Subsequent Warrants” shall mean a warrant or series of warrants to purchase the aggregate number of shares of New Athletics Common Stock determined pursuant to Section 5.2 hereof, if applicable, to be issued to VPVP pursuant to the terms of Section 5.2 hereof, if applicable, which Warrant or Warrants, if issued, shall be executed and delivered in substantially the form attached hereto as Exhibit A.
Subsequent Warrant has the meaning specified in Section 2.3 below.

  • Further, if a warrant to purchase Company’s common stock was issued pursuant to this Agreement then Purchaser shall receive a warrant in the form as the same form and substance as the warrant issued pursuant to this Agreement (“Subsequent Warrant”), provided that the Termination Date of the Additional Warrant shall be the fifth (5th) anniversary from the issue date of the Subsequent Warrant.

  • If the Holder elects to exchange the Warrant for a Subsequent Warrant, the Company agrees to enter into a side letter with the Holder relating to such Subsequent Warrant, which side letter will provide for (based on the good faith agreement of the Holder and the Company) any material terms of this Warrant which are not provided for in the Subsequent Warrant.

Warrants means the Initial Warrants and the Subsequent Warrant.
Subsequent Warrant means any warrant issued pursuant to the Credit Agreement in connection with a Delayed Draw Loan.
Subsequent Warrant means the Common Stock purchase warrant to be issued to the Purchaser at the Subsequent Closing, if any, in the form of Exhibit E, entitling the Purchaser to purchase up to 30,000 shares of Common Stock (subject to adjustment as therein provided) in accordance with the terms thereof.
