Examples of Swingline Lender in a sentence
The Swingline Lender shall make each Swingline Loan available to the Borrower by means of a credit to the general deposit account of the Borrower with the Swingline Lender (or, in the case of a Swingline Loan made to finance the reimbursement of an LC Disbursement as provided in Section 2.05(e), by remittance to the applicable Issuing Bank), in each case by 3:00 p.m., New York City time, on the requested date of such Swingline Loan.
Nothing herein shall release any Defaulting Lender from any obligation it may have to the Borrowers, the Agent, the Issuing Bank, Swingline Lender or any other Lender.
The Borrower hereby unconditionally promises to pay to the Swingline Lender the then unpaid principal amount of each Swingline Loan on the earlier of the Revolving Termination Date and the first date after such Swingline Loan is made that is the 15th or last day of a calendar month and is at least two (2) Business Days after such Swingline Loan is made; provided that on each date that a Revolving Borrowing is made, the Borrower shall repay all Swingline Loans then outstanding.
The Administrative Agent will promptly advise the Swingline Lender of any such notice received from the Borrower.
Each Guarantor’s right of contribution shall be subject to the terms and conditions of Section 11.4. The provisions of this Section 11.10 shall in no respect limit the obligations and liabilities of any Guarantor to the Agent, the Issuing Lenders, the Swing Line Lender and the Lenders, and each Guarantor shall remain liable to the Agent, the Issuing Lender, the Swingline Lender and the Lenders for the full amount guaranteed by such Guarantor hereunder.
