The Contractor must. (a) create, maintain and follow a documented process for maintaining the integrity of Information while possessed or accessed by the Contractor; and (b) comply with the information integrity requirements set out in Appendix G4, if attached.
The Contractor must perform the Works in a professional and competent manner with due care, skill and diligence and within the time specified in the Purchase Order;
The Contractor must. 1. put in place arrangements to log activity of data users in respect of electronically held protected personal information, and for managers to check it is being properly conducted, with a particular focus on those working remotely and those with higher levels of functionality. Summary records of managers’ activity must be shared with the Authority and be available for inspection by the Information Commissioner’s Office on request; 2. minimise the number of users with access to the Authority Data. In the absence of specific instructions from the Authority, all the data identified in the table below is data whose release or loss in the Authority’s view could cause harm or distress to individuals. The Contractor and its sub-contractors must treat the information identified below as protected personal data.
The Contractor must i. take out and maintain insurance during the Contract Period against statutory and common law liability for personal injury to or the death of any person in the employment of the Contractor; and ii. ensure that each subcontractor engaged during the Contract Period takes out and maintains insurance against statutory and common law liability for personal injury to or the death of any person in the employment of the subcontractor; and iii. where permitted by law, ensure the insurance is extended to provide indemnity for NAFC and the Members for NAFC’s statutory liability to persons employed by the Contractor.
The Contractor must. 9.4.1. ensure that all sub-contractors undertake their duties and responsibilities with professional skill, care and diligence expected of a service provider experienced in the aspect of the Services to be undertaken by the sub-contractor; 9.4.2. ensure that the sub-contractors do not commence activities until an agreement relating to HSEC issues in line with this Agreement has been concluded between the sub-contractor and Glencore, and the sub-contractor is fully conversant with the provision of and comply with the responsibilities set out in the OHS Act and/or the MHS Act (as applicable) and this Agreement; 9.4.3. manage and co-ordinate the activities of the sub-contractor to ensure compliance with the terms of this Agreement; and 9.4.4. before allowing any sub-contractor on the Site, give Glencore the following details: 9.4.4.1. identity of the sub-contractor and details of the activities to be executed by the sub- contractor; 9.4.4.2. period for which the sub-contractor will be on the Site; and 9.4.4.3. details of the sub-contractor’s employees.
The Contractor must. (a) promptly notify the University in writing of any occurrence arising out of or in connection with the Contract that may give rise to a claim under any of the insurance policies required to be effected and maintained by the Contractor or a subcontractor under this Contract; (b) keep the University informed of subsequent developments concerning any claim; and (c) ensure that any subcontractors are required to inform both the Contractor and the University in respect of occurrences which may give rise to a claim.
The Contractor must. (a) keep and maintain Records in accordance with prudent business practice and all applicable laws; (b) make sure the Records clearly identify all relevant time and expenses incurred in carrying out the Works; (c) make sure the Records are easy to access; and (d) keep the Records safe.
