Therapeutic Products definition

Therapeutic Products means products that are Licensed Products that are considered drugs pursuant to the definition of “drug” in 21 U.S.C. § 321 (g)(1) or comprises a formulation, prodrug or derivative of 3’SL, 2’FL or 6’SL that would be considered a “drug” pursuant to the definition 21 U.S.C. § 321 (g)(1).
Therapeutic Products shall refer to and mean products or services other than Diagnostic Products that (i) are used in the treatment of disease in humans, and (ii) employ, are in any way produced by the practice of, are identified using or arise out of any research involving the inventions claimed in the Licensed Patents or that would otherwise constitute infringement of any claims of the Licensed Patents.
Therapeutic Products means any Licensed Products or derivatives thereof, sold, used, manufactured or distributed by EMPIRICA, its Affiliates, any Sub-Licensees under this Agreement as a therapeutic product anywhere in the Territory;

  • Additionally, MCIT acknowledges and agrees that OXIS shall have the right to conduct pre-clinical and clinical development activities for Licensed Human Therapeutic Products in the Territory by using Licensed Research Products incident to such research activities in vitro and in vivo in mammals (other than humans) as permitted in Section 3.1(i) above.

  • Such termination will not affect the rights and obligations of the parties accrued prior to the termination, including the right of OSI to receive royalties on subsequent sales of Licensed Human Therapeutic Products, and OSI shall be entitled to an exclusive license under Wyeth Patent Rights and Wyeth Technology in the Target area(s) on the same terms under which Wyeth is exclusively licensed under OSI Patent Rights and OSI Technology as provided for in this Agreement.


More Definitions of Therapeutic Products

Therapeutic Products means products which have received, or are intended to receive approval or clearance by the agency or agencies having authority to grant the right to commercialize (sales and promotion) such products for in vitro or in vivo therapeutic use in the United States.
Therapeutic Products means pharmaceutical products that contain a Collaboration Antibody for the treatment of any human disease. For purposes of this Agreement, two pharmaceutical products that satisfy the foregoing definition of “Therapeutic Product” will be deemed to be different Therapeutic Products if they contain different Collaboration Antibodies.
