Contractor shall obtain P&I Insurance for Charterer’s Risks or a Time Charterer Protection and Indemnity policy/entry with P&I War Risk coverage for the United States of America (as Charterer) covering all risks typically covered by P&I Insurance for Charterer’s Risks or Time Charterer Protection and Indemnity entries with P&I War Risk coverages in Protection and Indemnity associations that are members of the International Group.
Contractor shall make insurance claims under the Time Charterer Protection and Indemnity policy/entry described in this section when directed by Charterer.
The Lessee shall not, and shall procure that no other Transaction Company nor the Time Charterer will, create or permit to exist any Security Interest over or in respect of the Insurances save for the approved brokers’ or insurers’ right of set off and lien for unpaid premiums to the extent permitted by clause 13.8, and save for any security interest created by the Lessee in favour of the Security Trustee pursuant to and in accordance with the Proceeds Deed.
The Sellers may leave onboard for use by the Time Charterer under the Time Charter Party items which Sellers are entitled to take ashore and other items excluded from the sale.
In this event, the terms and conditions of such services as are rendered and applied by independent tugboat owners or pilots shall be applicable; and Time Charterer or its Affiliates or otherwise related companies and their pilots shall be entitled to all exemptions from and limitations of liability, applicable to such independent tugboat owners or pilots and their published tariff terms and conditions.
