TOP-HEAVY PROVISIONS. As specified in the Adoption Agreement, the provisions of this Article XIII will either (1) always supersede any conflicting provisions in the Plan or (2) only supersede such conflicting provisions in any Plan Year beginning after 1983, during which the Plan is or becomes Top-Heavy.
TOP-HEAVY PROVISIONS. The Plan will be considered a Top Heavy Plan for any Plan Year if it is determined to be a Top Heavy Plan as of the last day of the preceding Plan Year. The provisions of this Section 10.2 shall apply and supersede all other provisions in the Plan during each Plan Year with respect to which the Plan is determined to be a Top Heavy Plan. (A) For purposes of this Section 10.2, the following terms shall have the meanings set forth below:
