Underlying Rights definition

Underlying Rights means the rights, obligations, restrictions and limitations granted or imposed upon the County or the County Network by authorizations, easements, licenses, leases, conduit access agreements, pole attachment agreements, aerial attachment or conduit rights, or tariffs of Facility Third Parties.
Underlying Rights means any and all agreements, licenses, conduit use agreements, pole attachment agreements, leases, easements, rights-of-way, franchises, permits, governmental and regulatory approvals and authorizations, and other rights, consents, and approvals that are necessary to construct, install, maintain, operate, and repair the Crown Castle Network and/or for Crown Castle to provide a Product other than building access rights described in Section 7.1. Without limiting the foregoing, Underlying Rights include agreements for Off-Net Products that are necessary for Crown Castle to provide a Product. “Off-Net Products” shall mean any products provided by a third-party. “On-Net Products” shall mean Products that use transmission and related facilities owned and controlled by Crown Castle.
Underlying Rights has the meaning set forth in Section 10.01.

  • The County shall have the sole discretion to determine the standards and methods by which Strands enter and exit the County Network and connect to the Licensee's Equipment, consistent with applicable Laws, Underlying Rights and Codes.

  • The Licensee shall periodicallyinspect the Licensee's Equipment and shall keep, operate, maintain and repair the Licensee's Equipment in accordance with Laws, the Codes and Underlying Rights at the Licensee's sole expense.

Underlying Rights means all easements, licenses of occupation, rights-of-way or other similar rights held, owned or acquired or to be held, owned or acquired, by the Vendor with respect to the land, structures, bridges, tunnels or buildings through which the Fiber Optic Cable or any of them passes and upon which certain of the Communications Shelters and Co-Location Facilities may be located; and "Right-of-Way" means one of the Rights-of-Way.
Underlying Rights means, with respect to particular end points, all licenses, leases, easements, rights-of-way, deeds, franchises, permits, authorizations, consents and approvals (including without limitation, any necessary local, provincial federal or First Nations authorizations and environmental permits) and other rights, titles, or interests as are necessary for the construction, installation, operation, maintenance or repair of the Urbanlink System between such end points.
