Use of Contractors. (a) If the employer wishes to engage contractors and their employees to perform work in the classifications covered by this agreement, the employer must first consult in good faith with the union. Consultation will occur prior to the engagement of sub-contractors. (b) If the employer decides to engage subcontractors, the employer shall ensure that these contractors and their employees receive wages, allowances and conditions equal to or better than those contained in this agreement. (c) The use of sham sub contracting arrangements is a breach of this agreement. The contractor who engages subcontractors is responsible for ensuring the employees of sub- contractors receive wages, allowances and conditions equal to or better those contained in this agreement, this obligation extends to liability for all outstanding wages conditions and entitlements under this agreement.

However, under no circumstances shall the use or hiring of a qualified third party contractor or agent relieve the Responsible Entity of any liability hereunder.
Use of Contractors. Each party may retain third parties ("Contractors") to furnish services to it in connection with the performance of this Agreement and permit such Contractors to have access to the other party's Confidential Information, but only to the extent and insofar as reasonably required in connection with such party's performance under this Agreement; provided that all such Contractors shall be required to execute a written agreement sufficient to secure compliance by the Contractors with the contracting party's obligations of confidentiality concerning Confidential Information set forth in this Agreement.
Use of Contractors. If a Contractor is performing any work described herein on behalf of the USER AGENCY, Director of Information Technology of SYSTEM PROVIDER shall be notified in advance. The USER AGENCY shall insert the following paragraphs as special provisions to any Contractor chosen to do the work: The Contractor shall defend, indemnify and save the City of Overland Park, Kansas harmless from and against all liability for damages, costs and expenses including attorney fees arising out of any claim, suit, action or otherwise for injuries and/or damages sustained to persons or property by reasons of the acts or omissions of the Contractor, or its sub-contractors, agents or employees in the performance of its contract. The City of Overland Park, Kansas shall be named as an additional insured on all policies of insurance issued to the Contractor and required by the terms of the Contractor's agreement with the USER AGENCY.
Use of Contractors. 12.1 Nothing in this Agreement or the appendices thereto shall limit the right of the Company from utilizing contractors, except that the Company may not utilize contractors to perform work ordinarily and customarily performed by its regular employees if, as a direct result thereof, it would become necessary to lay-off, part-time, or demote any employee currently performing the work being contracted. 12.2 The Company recognizes that the use of individuals on layoff who have recall rights may in any given situation be a viable alternative to the use of contractors. The Company will offer a laid off individual(s) with recall rights (under the applicable local Collective Bargaining Agreement) the opportunity for reemployment before utilizing a contractor(s) to perform work for which the individual on layoff has recall rights. All recall provisions in the applicable local Collective Bargaining Agreement will apply. Reemployment in such circumstances may be on a regular or a temporary basis, as the Company determines necessary based on the needs of the business. 12.3 The restrictions in Section 12.1 and Section 12.2, above, do not apply to the Vehicle Maintenance Mechanic and Vehicle Maintenance Technician work functions and, effective October 1, 2016, to the Lineworker and Equipment Installer work functions, subject to the Company’s commitment in the Workforce Adjustment Incentives MOA that the Company will maintain a core group of 10 or more Equipment Installers in the IBEW Local 89 bargaining unit. 12.4 The Company will provide the Union with quarterly reports of contractor usage in the Lineworker work functions.

Use of Contractors. Personnel provided to EDUCATIONAL INSTITUTION are employees of MAXIM and are subject to MAXIM’S standard screening process, as well as additional qualifications as required in this Agreement. From time to time, XXXXX may utilize the services of Contractors for reasons including, but not limited to, EDUCATIONAL INSTITUTION (i) requests Clinical Personnel who are contracted with Maxim Physician Resources, LLC d/b/a Xxxxx Xxxxx Xxxxxx and Advanced Practitioners in accordance with Article 7 hereof; or (ii) makes a request resulting in an unexpected surge and need for Personnel and use of Contractors is necessary to meet the requirements under this Agreement. If MAXIM deems it necessary to obtain the services of a Contractor, MAXIM will ensure that any Contractor who is to provide Personnel to EDUCATIONAL INSTITUTION complies with all applicable terms of this Agreement. Any Clinical Personnel provided to EDUCATIONAL INSTITUTION by a Contractor will be subject to the Clinical Personnel Requirements set forth in Section 2.2 hereof.
