The Authority reserves the right to perform construction or operations related to the Project with the Authority’s own forces and to award separate Trade Contracts or Vendor Contracts in connection with other portions of the Project or other construction or operations on the Project Site under conditions substantially similar to this Trade Contract Agreement, including those portions related to insurance and waiver of subrogation.
Until such time as Noble is able to enter into the amendments referenced in the foregoing sentence, Noble shall make payments to the vendors under the Remaining Vendor Contracts, and the Partnership shall reimburse Noble for any such payments made on its behalf.
