Winning Bidder definition

Winning Bidder. With respect to a Successful Auction, the Qualified Bidder that bids the highest price.
Winning Bidder means the Entity or Entities whose bid or bids for some or all of the Debtors’ assets, which for the avoidance of doubt may include the transaction contemplated under the Plan, is selected by the Debtors and approved by the Bankruptcy Court as the highest or otherwise best bid pursuant to the Bidding Procedures. For the avoidance of doubt, if there is no third-party purchaser of the assets, the Term Loan Lenders shall be deemed to be the Winning Bidder in accordance with the other terms and provisions of the Plan.
Winning Bidder means the Bidder who is recognized by Auctioneer as having made the Winning Bid.

  • In the event hereby that all of the rights and remedies of Seller available either a Winning Bidder fails to submit the signed Addendum and xxxxxxx money pursuant to the terms of this Agreement, or under the law or otherwise, deposit as stipulated in the Agreement, the Winning Bidder will be charged are cumulative and not exclusive of any other such right or remedy.

Winning Bidder shall have the meaning ascribed to such term in the Bidding Procedures Order.
