  • Xxxxxxx shall be solely responsible for all decisions regarding the prices charged for the Licensed Products in the Field, as well as discounts and rebates, in the Xxxxxxx Territory.

  • Subject to its obligation to use Commercially Reasonable Efforts to Commercialize the Licensed Products (for which Regulatory Approval has been received) in the Field in the Xxxxxxx Territory, any marketing of a Licensed Product in the Field in one market or country in the Xxxxxxx Territory shall not obligate Xxxxxxx to market such Licensed Product in the Field in any other market or country in the Xxxxxxx Territory.

  • Sales of the Licensed Products in the Field in the Xxxxxxx Territory shall be booked by Xxxxxxx (or its Affiliates or Sublicensees).
