This paper aims to determine whether the principle of social solidarity function of contract, binds business contracts and third parties to the principle of sustainable development. The third generation rights are aims protection of solidarity. In this sense, business associations, concerned with business and environmental ethics, should not be concerned only with profitability, but may seek, through the company's social function, the improvement of the whole society, the environmental protection and sustainable development. Also considers whether the constitutional principles have direct efficacy in private affairs, and if both the principle of the social function of the contract and the principle of sustainable development can regulate private relations , and among them, the contractual relationships. Through extensive literature research, this article, which deals with business contracts with third parties, uses the hypothetical- deductive method to achieve the desired objective.
