附件二 天合联盟非自愿免签转协议
天合联盟非自愿免签转协议(节选)
1. 协议适用范围:
(1)适用于以天合联盟成员票证及其附属成员票证填开的,不管何种票价的运输凭证或客票(其中包括常客用累积里程兑换的免票,但不包括无运输收入的代理人免票和航空公司免票)。成员包括: AF AM AZ CZ DL KE KL KQ NW OK SU UX MU FM。
(2)适用xxx联盟成员及其附属成员承运的任何航班。
(3)适用于航班发生不正常情况时的办理。航班不正常指由于天气、工人运动、大罢工、机械故障或因航班安排使成员航班被取消、改变或延误而导致旅客错失衔接。
(4)天合联盟成员或其附属成员间签订的双边或多边非自愿免签转协议优先于本协议。
(5)对本协议进行的任何修改均需要事先征得天合联盟成员及其附属成员的书面同意。
4. 协议条款:
(1)各成员及附属成员应尽量按下列优先顺序为更改航程的旅客重新安排航班: a.原承运人承运的航班
b.其它天合联盟成员或附属成员承运的航班
c.非联盟成员承运的航班(出于特殊照顾的考虑,只满足精英旅客、头等舱、公务舱旅客的要求)
(2)天合联盟成员应按照国际航空运输协会 735D 号决议的规定,免签转地接收非自愿更改航程至最终目的地的旅客客票。但如果旅客被安排至非天合联盟成员或非天合联盟附属成员承运的航班上,则其客票需要办理签转手续。
(3)在上述不正常航班的情况下,天合联盟成员及其附属成员可免签转地接收旅客所持的有限制性签注的客票。有限制性签注是指类似“仅限于 XX 承运的航班”(XX 为天合联盟成员或其附属成员),或“未经出票地同意不得签转不得退票”等内容。
但以下情况除外:在硬包座位的代码共享航班上,客票由市场方的航班转至承运方的航班或者由承运方的航班转至市场方的航班,必须办理签转手续,客票需注明“Endorsed to XX by XX”。如果两个承运人在同一城市均有执行航班的,他们之间的客票签转必须办理相应的签转手续。
Involuntary Endorsement Waiver Agreement Overview
Each member airline shall sign, maintain and/or implement an Involuntary Endorsement Waiver Agreement, authorizing each carrier to re-accommodate any SkyTeam passengers who are involuntarily rerouted.
Scope of the Agreement
The terms of this agreement shall apply to all passenger transportation documents and all ticketed passengers regardless of the fare paid (including frequent flyer award tickets but excluding non-revenue agency and industry tickets) which are issued/plated on carriers who are members of the Sky Team alliance.
The Sky Team alliance members are:

The terms of this agreement apply to any flight operated by a SkyTeam member. The terms of this agreement shall apply in the event of irregular operations, where irregular operations are defined as the cancellation, diversion or delay of a member’s flight due to weather, job actions, work stoppages, strikes, mechanical difficulties or where operational reasons the passenger misconnects.
This Agreement is superseded by any bilateral or multilateral involuntary endorsement waiver agreement that may exist between or amongst any of the parties hereto.
This agreement shall not be, in whole or part, modified without the prior written consent of the parties hereto.
Period of Application
This agreement is effective for passenger transportation documents lifted on/after September 15, 2004 and will continue through the duration of the Sky Team alliance.
Each party agrees to remain a party to this agreement while it is a member of SkyTeam. Each party agrees that its participation in this agreement shall automatically terminate upon the termination of such party's membership in SkyTeam. Any party may terminate its participation in this agreement upon 30 days prior written notice to the other parties. A party's (or parties') termination of its participation in this agreement shall not affect the obligations of the other parties to each other under this agreement.
Termination of this agreement or withdrawal from participation in this agreement by a party or parties shall not relieve the parties of their obligations incurred hereunder on/before the effective date thereof.
Confidentiality
No party to this agreement will disclose to any party which is not a party to this agreement the financial terms or any other confidential information of this agreement.
Terms of Agreement
The parties to this agreement shall make their best efforts to re-accommodate passengers who are rerouted under the terms of this agreement in the following priorities:
· On the original operating carrier , or
· On another carrier which is party to this agreement, or
· On a carrier other than SU, AM, UX, AF, AZ, CI, MU, CZ, OK, DL, KQ, KL, KE, RO, or VN (upon passenger request with special consideration to Elite/First Class/
Business Class passengers).
· Under the terms of this agreement, the new receiving carrier shall accept flight coupons without endorsement which are presented for involuntary rerouting to the final destination named on the passenger’s ticket as outlined in IATA Resolution 735d. In cases of involuntary operations, passengers should be rebooked utilizing operating carrier code. In those cases where the passenger is being reaccommodated on a non-SkyTeam carrier, an endorsement would be required.
· In an irregular operation as defined above, passenger transportation documents issued with restrictive endorsements such as “Valid on XX services only” (when XX stands for a carrier which is party to this agreement) or “Non-endorsable/non-refundable without prior ref. to issuing office” may be accepted without endorsement by any carrier which is party to this agreement.
Exception: For passenger transportation documents issued in connection with block space code share flights (i.e. trunk routes), passengers ticketed to travel on one party’s allotment shall not be uplifted on the other party’s allotment without proper endorsement. Proper endorsement shall state“endorsed to XX by XX”. In cities where both carriers operate, the endorsement must be validated by the applicable carrier endorsement stamp. Tickets lifted under the terms of this agreement shall be settled at the published fare collected, subject to application of any bilateral settlement terms.
