Ambassador Bowl Training Camp Disclaimer Agreement
为了保证训练营活动，加强训练营组织方与参训人员的交流与合作，甲乙双方签订大使碗训练营免责协议。本协议中，甲方是本次训练营活动的组织者xxxxxxxx，x方是自愿报名参训人员。经甲乙双方友好协商，根据《中华人民共和国合同法》、《中华人民共和国体育法》以及有关的法律法规的规定，为明确双方的权利义务，就有关事宜达成如下协议：
In order to safeguard the training camp activities and strengthen the exchanges and cooperation between the training camp organizers and the participants, the two parties signed an ambassador bowl training camp exemption agreement. In this agreement, Party A is the organizer of this training camp, Shanghai Rugby Association, and Party B is a volunteer to register for the training. The following agreements were reached on the below relevant matters through friendly consultations between the two parties, in accordance with the "Contract Law of the People's Republic of China", the "Sports Law of the People's Republic of China" and relevant laws and regulations, in order to clarify the rights and obligations of both parties:
第一条 时间与地点
x协议包含的时间为 2019 年 2 月 16 日、2 月 17 日、2 月 23 日、2
月 24 日、3 月 2 日、3 月 3 日、3 月 9 日共计七天。具体训练日程、地点和报到的日期按照训练营规程的规定，如有临时变动，则按照变动的时间进行。
1) Time and place
This agreement runs for three weeks between the following dates. February 16, 2019- February 23, February 24 - March 2 and March 3
- March 9. The specific training schedule, location, and date of registration are in accordance with the regulations of the training camp. If there are temporary changes, then please follow the time of the change.
第二条 风险的承担
乙方自愿参加此次活动。需以乙方理解、乙方同意为前提，在签署本协议并生效后，方可参加本次活动。
2) Risk bearing
Party B understands they volunteered to participate in the event. This is subject to the understanding and consent of Party B. After signing this agreement and taking effect, you can only can participate in this activity once this agreement is signed and takes effect.
第三条 关于豁免责任，放弃权利和赔偿的声明书
3.1 乙方参加此次活动，包括、但不限于训练运动内容，在此乙方同意，如果因为参加此活动(包括途中)和在活动中使用装备而受到伤害的话，乙方放弃向甲方追究和要求赔偿的权利，同时免除同队其他成员的法律责任。
3.1 Declaration on immunity from waiver and waiver of rights and compensation
3.1 Party B participates in the event, including, but not limited to, the
content of the training exercise. Party B agrees that Party B shall waive and claim compensation from Party A if it is harmed by participating in this activity (including en route) and using the equipment during the event. At the same time, the legal responsibility of other members of the same team is waived.
3.2 乙方理解如遇需要医疗服务的情况，所有救援和医疗的费用将由乙方自己承担。乙方理解当参加训练活动时，乙方有可能面对真实的风险而受到伤害。这些风险包括训练运动过程中各种意外情况。乙方清楚获知活动计划的甲方无法全面预见该活动中所有的风险和不利，乙方理解以上所列的风险并不完全含括了此次活动中的所有可能的风险，并且同意免责和放弃权利的声明书并不仅限于以上所列的风险中。
3.2 Party B understands that in case of medical service needs, all rescue and medical expenses will be borne by Party B. Party B understands that when participating in the training activities, Party B
may be harmed in the face of real risks. These risks include various accidents during the training exercise. Party B clearly understands that Party A cannot fully predict all the risks and disadvantages of the activity plan. Party B understands that the risks listed above do not fully cover all possible risks in the activity, and agree to exempt and waive the rights. The statement is not limited to the risks listed above.
3.3 乙方理解并清楚知道身体活动和装备的使用是有潜在危害的。乙方也理解训练活动包含有导致受伤，引发心脏病等疾病的风险，乙方知道有可能涉及危险，乙方自愿参加这些活动和使用活动的装备。因此，乙方同意承担和接受任何和所有的伤害的风险，并且乙方永远免除此次活动的甲方的法律责任，同时乙方承担同行伙伴任何和所有的伤害的风险所产生的所有法律责任。
3.3 Party B clearly understands that physical activity and the use of equipment are potentially harmful. Party B also understands that the training activities involve the risk of causing injuries and causing diseases such as heart disease etc. Party B knows that there may be risks involved, and Party B voluntarily participates in these activities and uses the equipment. Therefore, Party B agrees to bear and accept the risk of any and all injuries, and Party B will always waive the legal liability of Party A of this activity, and Party B shall bear all legal liabilities arising from the risk of any and all injuries of its partners.
3.4 乙方同意承担所有的个人受到伤害的风险，这些风险是可能发生 在往返参加活动的途中，或者是在参加活动的时候。乙方清楚获知乙 方已经被提供了自由选择的权利，可以选择往返活动地点的交通方式。乙方同意承担由于乙方选择了自己的交通方式往返活动地点，而引起 的相关的风险和责任。
3.4 Party B agrees to bear the risk of injury to all individuals, which may occur on the way to and from the event, or when participating in the event. Party B clearly knows that Party B has been given the right to freely choose and can choose the mode of transportation to and from the place of activity. Party B agrees to bear the risks and liabilities arising from Party B's choice of its own mode of transportation.
3.5 乙方清楚获知此次活动的成员都和本人一样是自愿的参与者，其并不承担法律责任，意外保险和健康保险等。乙方了解自行购买保险的意义，以防任何的伤害。
3.5 Party B clearly understands that the members of the event are individual volunteers, and they do not bear legal liabilities, accident insurance and health insurance. Party B understands the meaning of purchasing insurance on its own to prevent any harm.
3.6 乙方理解乙方能够通过以下措施来减少乙方的风险：更加注意环
境，注意乙方的身体和精神状况，注意所有与安全相关的衣物和装备的适用状况和只参加哪些自己精神和身体能力之内的活动。乙方清楚获知乙方有权利去询问活动的发起人以要求解释任何引起乙方觉得不适的决定。乙方同意乙方将不会参加任何会危害到自身的活动，除非乙方已经仔细考虑过，相信它是安全的，和接受所有的相关风险。乙方清楚获知，乙方的安全是乙方个人的责任和取决于乙方的警惕和良好的判断。乙方同意和保证，任何时候乙方相信条件是不安全的，那么乙方会立刻中断活动的进一步参加。
3.6 Party B understands that Party B can reduce their own risk by taking the following measures: paying more attention to the environment, paying attention to the physical and mental condition of Party B, paying attention to the applicable conditions of all safety- related clothing and equipment and those of their own mental and physical abilities. Party B clearly understands that Party B has the right to ask the sponsor of the event to request to explain any decision that causes Party B to feel uncomfortable. Party B agrees that Party B will not participate in any activities that will endanger itself, unless Party B has carefully considered it, believes that it is safe, and accepts all relevant risks. Party B is clearly aware that the safety of Party B is the responsibility of Party B and depends on Party B’s vigilance and good judgment. Party B agrees and guarantees that Party B will inevitably interrupt any further participation of the event at any time if Party B
believes that the conditions are unsafe.
3.7 在此乙方向甲方宣布乙方自己身体健康，没有完全会影响乙方参加活动或使用装备的不适损伤、病痛或其它疾病，除了以下声明的情况。乙方清楚获知，乙方已经被知会，乙方需要医生批准才能参加活动或使用装备。乙方也获知，乙方应该进行年度或更频繁的身体检查，并咨询乙方的医生有关乙方参加体力活动，练习和装备使用的情况，以便乙方可以获得有关健身活动和装备使用的建议。乙方清楚获知，乙方要么就进行身体检查并获得医生的批准去参加活动；要么就决定在没有获得医生批准的情况下参加活动，并特别在此承担所有的由参加活动引起的责任。
3.7 In this direction, Party B declares that Party B is in good health and this does not affect Party B's participation in activities or equipment, such as discomfort, illness or other diseases, except as indicated below. Party B clearly understands that Party B has been informed that Party B needs medical approval to participate in activities or use equipment. Party B is also informed that Party B should conduct an annual or more frequent physical examination and consult Party B's doctor about Party B's participation in physical activity, practice and equipment use, so that Party B can obtain advice on fitness activities and equipment use. Party B is clearly aware that Party B will either take a physical examination and obtain the doctor's approval to participate in the
activity; or decide to participate in the activity without the approval of the doctor, and in particular hereby assume all the responsibilities arising from the participation activities.
3.8 乙方完全理解，在同伴需要协助的时候，乙方可能会尽力协助乙方的同伴，但这只是在以下情况:在乙方的判断中，这是自己力所能及的范围内，并且不会给自己带来不合理的危险。乙方进一步理解到，乙方没有法律上的责任去协助别人，同时，任何乙方的同伴或者其他成员也没有任何法律上的责任来协助乙方。
3.8 Party B fully understands that when the companion needs assistance, Party B may try its best to assist Party B's companions, but this is only the following situation: In Party B's judgment, this is within the scope of their own ability and will not bring themselves no Reasonable danger. Party B further understands that Party B has no legal responsibility to assist others. At the same time, any of Party B's companions or other members have no legal responsibility to assist Party B.
3.9 在此次活动中，如果由于乙方的行为和乙方的参加而导致了第三方的财产损失或个人伤害，乙方应依据法律规定承担相应的责任，乙方的上述行为造成甲方损失的，甲方有权向乙方进行追偿。
3.9 In this activity, in case property loss or personal injury is caused to
a third party by the behavior of Party B and the participation of Party B, Party B shall bear corresponding responsibility according to the law. If Party B’s above actions result in Party A’s loss, Party A have the right to claim this from Party B.
3.10 乙方理解，对由于乙方参加活动而导致的乙方个人的意外事故，病痛和财产损失，活动甲方和其他成员不应承担责任。
3.10 Party B understands that Party B and other members shall not be liable for Party B’s personal accidents, illnesses and property losses caused by Party B’s participation in the activities.
第四条 协议的同意、保证、及签署
Article 4 Agreement, Guarantee, and Signature of the Agreement
4.1 乙方同意，此责任豁免声明书在乙方签字后将生效。此声明书同样有效于乙方的继承人、近亲属、执行人、管理人和个人代表。
4.1 Party B agrees that this statement of liability exemption will take effect after Party B signs it. This statement is also valid for Party B's heirs, close relatives, executors, administrators and personal representatives.
4.2 乙方保证已经阅读和理解以上声明和其条文，乙方理解参加此次
训练活动相关的风险，乙方承担由于选择了参加此次训练活动而随之而来的全部责任。
4.2 Party B guarantees that the above statement and its provisions have been read and understood. Party B understands the risks associated with participating in the training activities, and Party B assumes all the responsibilities that come with the participation in the training activities.
4.3 乙方在此特意和有意的声明同意，对于由于参加任何和所有训练 运动及其他活动而引发或与之相关的，任何和所有的法律要求、需求、伤害、活动和无论任何形式和性质的损害，无论这些法律要求是基于 某方的疏忽或其它原因引起的，乙方免除甲方和同行其他成员的责任。
4.3 Party B hereby expressly and intentionally agrees to any and all legal requirements, needs, injuries, activities and any form or nature of damage arising out of or relating to participation in any and all training activities and other activities. Whether or not these legal requirements are caused by the negligence of the other party or other reasons, Party B shall waive the responsibility of Party A and other members of the same party.
4.4 书面签署表格与以上所列条款具有同等法律效力，本人签字确认后即时生效。请在下方签字(本人真实姓名)。
4.4 The written signing form has the same legal effect as the terms listed above, and will be effective immediately upon signature and confirmation. Please sign below (Real name).
4.5 本协议的效力适用于第一条所约定的时间，如时间有调整按甲方通知中确定的时间同样适用本协议。
4.5 The validity of this Agreement shall apply to the time agreed upon in Article 1. If the time is adjusted, the same applies to the time determined in Party A's notice.
