Composition of Agreement. The Unbranded Supply Agreement to which these General Terms and Conditions for Petroleum Product Purchases/Sales (Susser Petroleum) (the “General Conditions”) are attached (which Unbranded Supply Agreement is sometimes referred to as the “Special Provisions”), together with these General Conditions and if applicable, Valero Marketing and Supply Company’s Marine Provisions and/or Terminal Loading Agreement will constitute the agreement between the parties (the “Agreement”).

Composition of Agreement. This Agreement includes all of its accompanying text, the documents incorporated herein by reference, and any Addenda hereto, and constitutes the exclusive and entire agreement between Customer and Cohesity on its subject matter.
Composition of Agreement. The parties hereto represent that they have each read this Indemnification Agreement and each has sought and received competent legal counsel prior to its execution. The parties assume joint responsibility for the form and composition of each provision of this Indemnification Agreement and each acknowledge that this Indemnification Agreement shall be interpreted as though they shared equally in its preparation.

If there is a conflict between the Special Provisions and the General Terms, the Special Provisions will govern. Capitalized terms which are used but not otherwise defined in these General Terms shall have the meanings ascribed to them in the Special Provisions.

The Parties’ entire agreement concerning the SYSTEM consists of: (1) this Agreement; (2) the Exhibits to this Agreement; (3) the RFP; (4) the CONTRACTOR’S Proposal as it may be revised by mutual consent of DLEC and CONTRACTOR prior to execution of this agreement; and (5) any written Change Orders to this agreement which may be delivered, prepared or issued after the date of the Agreement.
