Common use of Notice of Extension Clause in Contracts

Notice of Extension. (a) If the Institutional Trustee is the only registered Holder of the Debentures at the time the Company selects an Extended Interest Payment Period, the Company shall give written notice to the Regular Trustees, the Institutional Trustee and the Trustee of its selection of such Extended Interest Payment Period one Business Day before the earlier of (i) the next succeeding date on which Distributions on the Trust Securities issued by the Trust are payable, or (ii) the date the Trust is required to give notice of the record date, or the date such Distributions are payable, to the New York Stock Exchange or other applicable self-regulatory organization or to holders of the Preferred Securities issued by the Trust, but in any event at least one Business Day before such record date.

Notice of Extension. (a) If the Institutional Property Trustee is the only registered Holder of the Debentures Notes at the time the Company selects Issuer elects an Extended Interest Payment Period, the Company Issuer shall give written notice to the Regular Trustees, the Institutional Property Trustee and the Trustee of its selection election of such Extended Interest Payment Period one Business Day before the earlier of (i) the next succeeding date on which Distributions on the Trust Securities issued by the Trust are payable, or (ii) the date the Trust is required to give notice of the record date, or the date such Distributions are payable, to the New York Stock Exchange or other applicable self-regulatory organization or to holders of the Preferred Securities issued by the TrustSecurities, but in any event at least one Business Day before such record date.

(a) If the Institutional Property Trustee is the only registered Holder of the Subordinated Debentures at the time the Company selects an Extended Interest Payment Period, the Company shall give written notice to the Regular Trustees, the Institutional Property Trustee and the Trustee of its selection of such Extended Interest Payment Period one Business Day before the earlier of (i) the next succeeding date on which Distributions on the Trust Securities issued by the Trust are payable, or (ii) the date the Trust is required to give notice of the record date, date or the date such Distributions are payable, payable to the New York Stock Exchange or other applicable self-regulatory organization or to holders of the Preferred Securities issued by the Trust, but in any event at least one Business Day before such record date.

(a) If the Institutional Trustee is the only registered Holder of the Convertible Debentures at the time the Company selects an Extended Interest Payment Extension Period, the Company shall give written notice to the Regular Trustees, the Institutional Trustee and the Trustee of its selection of such Extended Interest Payment Extension Period at least one Business Day before the earlier of (i) the next succeeding date on which Distributions on the Trust Securities issued by the Trust are payable, or (ii) the date the Trust is Regular Trustees are required to give notice of the record date, or the date such Distributions are payable, to the New York Stock Exchange or other applicable self-regulatory organization or to holders of the Convertible Preferred Securities issued by the Trust, but in any event at least one ten Business Day Days before such record date. The Company shall cause the Trust to give notice of the Company's selection of such Extension Period to holders of the Convertible Preferred Securities.

(a) If the Institutional Property Trustee is the only registered Holder holder of the Debentures at the time the Company selects elects an Extended Interest Payment Period, the Company shall give written notice to the Regular Trustees, the Institutional Trustee Administrative Trustees and the Property Trustee of its selection election of such Extended Interest Payment Period at least one Business Day before the earlier of (i) the next succeeding date on which Distributions on the Trust Securities issued by the Trust are payable, or (ii) the date the Trust is required to give notice of the record date, or the date such Distributions are payable, to the New York Stock Exchange or any other applicable self-regulatory organization or to holders of the Trust Preferred Securities issued by the TrustSecurities, but in any event at least one Business Day before such record date.

Notice of Extension. (a) If the Institutional Property Trustee is the only registered Holder regis tered holder of the Subordinated Debentures at the time the Company selects an Extended Interest Payment Period, the Company shall give written notice to both the Regular Trustees, the Institutional Trustee Trustees and the Property Trustee of its selection of such Extended Interest Payment Period one Business Day before the earlier of (i) the next succeeding date on which Distributions Distri butions on the Trust Securities issued by the Trust are payable, or (ii) the date the Trust is required to give notice of the record date, or the payment date for such Distributions are payable, to the New York Stock Exchange or other applicable self-self- regulatory organization or to holders of the Preferred Securities issued by the Trust, but in any event at least one Business Day before such record date.
