Common use of Section 13.5 Clause in Contracts

Section 13.5. 34 If the district determines that seniority rights should not govern because a junior employee possesses ability 35 and performance substantially greater than a senior employee, the District shall set forth in writing to the 36 employee and the association president its reasons why the senior employee has been bypassed.

Section 13.5. 34 38 If the district determines that seniority rights should not govern because a junior employee possesses 39 ability 35 and performance substantially greater than a senior employee, the District shall set forth in writing 40 to the 36 employee and the association president its reasons why the senior employee has been bypassed.
