Selection of Mediator. (a) If the Parties cannot agree on the selection of a mediator within 5 Business Days of the escalation of a dispute to mediation, either Party may apply to the president of the Australian Commercial Disputes Centre (ACDC) requesting the appointment of an independent mediator.
