The Hospital. 3.2.1 The Hospital will provide the Hospital Services and otherwise fulfill its obligations under this Agreement in accordance with the terms of this Agreement, Applicable Law, Applicable Policy and Program Parameters. Without limiting the foregoing, the Hospital acknowledges: that all Funding will be provided in accordance with the requirements of the Enabling Legislation, including the terms and conditions of the Accountability Agreement; that it is prohibited from using Funding for compensation increases prohibited by Applicable Law; its obligation to follow the Broader Public Sector Procurement Directive issued by the Management Board of Cabinet as the same may be replaced or amended from time to time; and its obligation to post a copy of this Agreement in a conspicuous public place at its sites of operations to which this Agreement applies, and on its public website if the Hospital operates a public website.

The Hospital i) The Hospital is solely responsible for establishing, maintaining and setting standards for delivery of clinical care and services and for the provision of patient care and the determination of which clinical services it will or will not provide. The Hospital acknowledges that the University is solely responsible for establishing courses and programs of study, determining standards for its students, faculty and teaching programs, and generally for all other matters of an academic nature relating to the education of students in the Hospital.

The Hospital. Diagnostic Centre shall provide the services as per the requirements specified by the’’ WBHS 2008’’ or the “Cashless Scheme,2014” in terms of the provisions of this Agreement. In case of initial violation of the provisions of the Agreement by the Hospital / Diagnostic Centre such as refusal of service or direct charging from the beneficiaries under the ‘’WBHS 2008’’ or the “Cashless Scheme ,2014” of rates in excess of agreed rates, irrational treatment or use of unnecessary drugs/ medicines/ procedures or defective service and negligence, false billing, the amount equivalent to 25% of the amount of Performance Bank Guarantee shall be charged as agreed Liquidated Damages under the ‘’WBHS 2008’’/ Cashless Scheme 2014. However, the total amount of the Performance Bank Guarantee shall be maintained intact being a revolving Guarantee.

The Hospital. Diagnostic Centre shall at all times abide by the job safety measures and other statutory requirements prevalent in India and shall keep free and indemnify the Authority under the ‘’WBHS 2008’’ / Cashless Scheme, 2014 from all demands or responsibilities arising from accidents or loss of life, the cause or result of which is the Hospital’s / Diagnostic Centre’s negligence or misconduct.
The Hospital. Diagnostic Centre shall notify the authority under the WBHS 2008 or the ‘Cashless Scheme,2014’ of any material change in their status and their shareholdings or that of any Guarantor of the Hospital / Diagnostic Centre where such change would have an impact on the performance of obligation under this Agreement.
