Time Delay. Files marked for storage shall only be added to the Storage server at the next periodic scan of your computer. Only after a periodic scan will a file be available as part of the Storage data. Comodo does not maintain a copy of the data backed up to our servers and does not guarantee the information against loss or destruction. In the event that this Agreement is terminated, Comodo may in its sole discretion and without notice to you delete or deny access to the backed up data and such data or files will not be available to you. Comodo and its affiliates may retain (but shall have no obligation to retain) your data for a period of time after your subscription to the Services expires in order to allow you to renew the Subscription Period if desired.

Time Delay. Automatic time delays are built into most electronic controllers. This helps avoid short cycling. A solid state time delay will be used for backup in the unlikely event of a electronic controller failure. The time delay will only be in the circuit during switch back, if the system uses switch back control. If the system does not have optional switch back control then it will be wired in series with the operating controls. Awareness of time delays will reduce frustration and confusion when starting or troubleshooting the system. Pressure Switches There are basically three pressure switches in the compressor control circuit. A low pressure switch is used to close the control circuit during high suction and open the circuit during low suction pressure. A high pressure switch is use to open the control circuit during a critical high discharge pressure state. The high pressure switch is available in automatic or manual reset. An oil pressure switch senses the supply oil pressure when the compressor is running. If the oil pressure falls below the preset setting, the control circuit will open. Oil pressure switches are preset for 6.5 psig differential (Carlyle) and 9 psig differential (Xxxxxxxx). The oil failure time delays are preset for 45 seconds (Carlyle) and 120 seconds (Xxxxxxxx). *For proper setting of switches see control settings section.

  • Excusable Delay The Contractor is entitled to an equitable adjustment of time, issued via Change Order, for delays caused by the following:

  • Concurrent Delay When the completion of the Work is simultaneously delayed by an excusable delay and a delay arising from a cause not designated as excusable, Contractor may not be entitled to a time extension for the period of concurrent delay.

  • Excusable Delays Except with respect to defaults of subproviders, the Engineer shall not be in default by reason of any failure in performance of this contract in accordance with its terms (including any failure to progress in the performance of the work) if such failure arises out of causes beyond the control and without the default or negligence of the Engineer. Such causes may include, but are not restricted to, acts of God or the public enemy, acts of the Government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, freight embargoes, and unusually severe weather.

  • Performance Delay Time is of the essence in the Vendor’s performance of this Agreement. If at any time it appears to Vendor that it may not meet any of the performance schedules or the scheduled completion date of the services to be performed for any reason, including labor disputes, Vendor shall immediately by verbal means (to be confirmed in writing) notify Customer of the reasons for and the estimated duration of such delay. If requested by Customer, Vendor shall make every effort to avoid or minimize the delay to the maximum extent possible including the expenditure of premium time. Any additional cost caused by these requirements of Customer shall be borne by Vendor, unless the delay in performance arises out of causes beyond the control and without the fault or negligence of Vendor or its subcontractors within the meaning of the Cancellation- Default clause herein. The foregoing requirements are in addition to any of Customer’s other rights and remedies as may be provided by law or this Agreement.

  • Operation Delays STATE shall have the authority to delay or suspend the operations of PURCHASER and contractors of PURCHASER, wholly or in part, under this contract for such period or periods necessary due to fire hazard conditions, severe weather occurrence, surveying for threatened or endangered species listed under the state or federal Endangered Species Act, or any other activity STATE determines to be necessary for identification, management, or protection of a threatened or endangered species. PURCHASER agrees to cooperate with surveying efforts of STATE or its contractors. In no event shall STATE be liable for any costs incurred by PURCHASER by reason of delay or suspension under this section, including but not limited to costs of additional move-in/move-out of equipment and personnel, extra fire and equipment security, and insurance or bonding expenses.

  • Payment Delay Notwithstanding any other terms of this Agreement, no payments will be made to CONTRACTOR until COUNTY is satisfied that work of such value has been rendered pursuant to this Agreement. However, COUNTY will not unreasonably withhold payment and, if a dispute exists, the withheld payment shall be proportional only to the item in dispute.

  • Standard Work Day The standard work day for non-shift employees shall be seven (7) hours exclusive of the meal period.

  • Unavoidable Delay When construction is impeded as a result of strikes, lockouts, acts of God or other factors beyond the control, and ability to remedy, of the Developer.

  • Standard Work Week The standard work week shall be thirty-five (35) hours and is composed of five (5) consecutive standard work days.

  • Five Day Work Week Schedule When working under the five (5) day work week schedule, Employees shall receive one and one-half (1.5x) times their regular rate of pay for the first two (2) hours of overtime Monday through Friday. All other overtime Monday through Friday shall be paid at double time (2x).
