Corrective Work definition

Corrective Work has the meaning set forth in Section 12.3.
Corrective Work means all activities of removal, response, investigation, testing, analysis, remediation (including, but not limited to disposal of Hazardous Substances) taken pursuant to Environmental Requirements (i) to prevent, xxxxx, or correct a Release or threatened Release of Hazardous Substances at, about, affecting, or affected by the Project or the Project Site or (ii) to comply with any and all Environmental Requirements applicable to the Project or the Project Site or areas at, about, affecting, or affected by the Project or the Project Site.
Corrective Work means the removal, relocation, elimination, remediation, encapsulation or any other treatment of Hazardous Substances of or from all or any portion of (i) the Property or any other property owned and/or leased by Borrower (necessary to maintain or bring the Property into compliance with environmental laws) and (ii) surrounding areas of the Property and or any other property owned and/or leased by Borrower (necessary to maintain or bring the Property into compliance with environmental laws) and, to the extent thereby required, the reconstruction and rehabilitation of the Property or any other property owned and/or leased by Borrower performed by any person or entity, including, without limitation, Borrower, any other Indemnitor, Lender, any Indemnified Party, any of their respective agents, contractors, subcontractors, employees and any governmental entity for any reason, including, without limitation, pursuant to any Environmental Laws.‌

Examples of Corrective Work in a sentence

  • All Corrective Work shall be performed subject to the same terms and conditions under this Agreement as the original Work is required to be performed.

  • In the event Contractor utilizes spare parts owned by Owner in the course of performing the Corrective Work, Contractor shall supply Owner free of charge with new spare parts equivalent in quality and quantity to all such spare parts used by Contractor as soon as possible following the utilization of such spare parts.

  • Any such notice from Owner shall state with reasonable specificity the date of occurrence or observation of the alleged Defect and the reasons supporting Owner’s belief that Contractor is responsible for performing Corrective Work.

  • Contractor shall be fully responsible and liable to Owner for its Warranty and Corrective Work obligations and liability under this Agreement for all Work, including Work performed by its Subcontractors and Sub-subcontractors.

  • In such event, Contractor shall be liable to Owner for the reasonable costs incurred by Owner in connection with performing such Corrective Work, and shall pay Owner, after receipt of written notice from Owner, an amount equal to such costs (or, at Owner’s sole discretion, Owner may withhold or offset amounts owed to Contractor or collect on the Letter of Credit in accordance with Section 7.8 in the amount of such costs).


More Definitions of Corrective Work

Corrective Work. The removal, relocation, elimination, remediation or encapsulation of Hazardous Materials from all or any portion of the Property and (to the extent provided in Subparagraph 2(b) hereof) surrounding areas and, to the extent thereby required, the reconstruction and rehabilitation of the Property pursuant to, and in compliance with, Governmental Requirements;
Corrective Work means all work required to re-construct the existing parking areas, curbs and internal roads in accordance with the Plans and in compliance with all federal, provincial and municipal legislative enactments, by-laws and regulations so as to conform to the Project.
Corrective Work means the removal, relocation, elimination, remediation or encapsulation, of Hazardous Material, from all or any portion of the Property, and surrounding areas and, to the extent thereby required, the reconstruction and rehabilitation of the Property (i) pursuant to, and in compliance with, Environmental Requirement, or (ii) if the present or future use, operation, leasing, development, construction, alteration or refinancing of the Property is limited or restricted in any way by reason of the existence of such Hazardous Material.
Corrective Work means have the meaning ascribed to such term in the Environmental Indemnification Agreement.
Corrective Work shall have the meaning as set forth in Section 6.1.
Corrective Work has the meaning set forth in Paragraph 12.2.2.
Corrective Work shall have the meaning set forth in General Condition 37, titled WARRANTY/DEFECT CORRECTION PERIOD.
