The Project Site. The site of the Resort and the Project Infrastructure shall comprise the land as described in Schedule A, and in respect of which the Right of Way shall be provided and granted by the Authority to the Concessionaire on a leave and licensee basis under and in accordance with this Agreement (the “Project Site”).

The Project Site. 10.1.1 The site of the Project shall comprise of land described in Schedule-1 and in respect of which the Right of Way shall be provided and granted by ULB to the Concessionaire as a licensee under and in accordance with this Agreement (the “Project Site”). In addition, ULB shall also provide and grant the Concessionaire the exclusive right to use the Existing Assets. It is made clear that the Concessionaire shall only have the rights of licensee i.e. right to use the Project Site and the Existing Assets for development of the Project under this Agreement and no right, title or interest in the Project Site and the Existing Assets are transferred or to be transferred in favour of Concessionaire under any circumstance.
The Project Site. The Project Site consists of certain real property commonly known as: 00000 XX Xxxxx Xxxx Xxx, Xxxxx Xxxx, Xxxxxxxxxx, as legally described in the attached Exhibit B (collectively “the Property”).

The remainder of the Project Site contains gravel pathways, an existing gravel driveway, trees, shrubs or grass and gravel or dirt drive areas. The site is legally described in the attached Exhibit A.
The Project Site. The Project Site is approximately 12 acres of land located immediately south of Xxxxxxxx Creek east of Bendigo Boulevard (SR-202) and west of Boalch Avenue NW, comprised of King County Tax Parcel Nos. 0423089036, 5418700030, 5418700005, 5418700025, 5418700010, 5418700020, and more particularly described in the attached Exhibit A.
The Project Site. 11.1.1 The Contracting Authority shall hand over the Original Site to the Project Company as a licensee under and in accordance with this Agreement with vacant access on or prior to the Effective Date free from any Encumbrances. Any breach of this Clause 11.1.1 (including the existence or exercise of any third party rights, , that do not allow undisturbed use of the Project Site subject to the permitted access pursuant to the terms of this Agreement or any Encumbrance) by the Contracting Authority shall constitute a Compensation Event.

Xxxxx Xxxxxx, which includes property both beneath the air rights parcel and property immediately north of the air rights parcel.
