Other Definitions. The following terms have the meanings ascribed to them in the Sections noted:

Other Definitions is hereby amended by adding to the table in its appropriate alphabetical order the term “Successor Guarantor,” which is defined in Section 5.01(c).

Other Definitions. The words "herein," "contained herein," and "established below" are words that are similar in meaning, when used in this Agreement, and refer to this Agreement in its entirety. The terms defined in the singular shall have a comparable meaning when used in the plural and vice-versa, according to the context.

Other Definitions. (u) An "Affiliate" of a corporation shall mean (a) any person or entity directly or indirectly controlled by such corporation, (b) any person or entity directly or indirectly controlling such corporation, (c) any subsidiary of such corporation if the corporation has a fifty percent (50%) or greater ownership interest in the subsidiary, or (d) such corporation's parent corporation if the parent has a fifty percent (50%) or greater ownership interest in the corporation. For purposes of this Section 2.1(u), Oncology is not an affiliate of Response.

Other Definitions. Unless otherwise defined in this Agreement, all capitalized terms in this Agreement will have the same meaning as provided under the Health Insurance Portability and Accountability Act (HIPAA) Standards for Privacy of Individually Identifiable Health Information, 45 C.F.R. Part 160 and Part 164, Subpart E (the Privacy Rule), the HIPAA Security Standards, 45 C.F.R. Part 160 and Part 164, Subpart C (the Security Rule), and the HIPAA Breach Notification Regulations, 45 C.F.R. Part 160 and Part 164, Subpart D (the Breach Notification Rule), all as amended from time to time.

Other Definitions. “Affiliated Companies” shall mean, with respect to the Company, any corporation, limited partnership, general partnership, association, joint-stock company, joint venture, trust, bank, trust company, land trust, business trust, fund or any organized groups of persons, whether or not a legal entity, that is directly or indirectly controlled by, controlling or under common control with the Company.
