Payment Network definition

Payment Network means a debit or credit network (such as the ACH Network or ACCEL / Exchange payment network) through which funds may be transferred.

• FORTE may immediately terminate this Agreement without prior notice in the event (i) that it determines AGENCY has experienced an actual or suspected data security breach; (ii) FORTE is instructed to terminate the Agreement by a financial institution, Acquirer or Payment Network; or (iii) FORTE observes irregular, suspicious or fraudulent Transaction activity on Merchant’s account that is reasonably determined to expose FORTE to risk of financial, reputational, or other measurable loss.

• FORTE and its associated credit card Acquirer have no obligation other than those expressly provided under the Rules of a Payment Network and applicable Law as they may relate to limited acceptance.

• Except with respect to Personal Information, this Section 4 will not apply to Confidential Information that (i) was already available to the public at the time of disclosure, (ii) becomes generally known to the public after disclosure to the other Party, through no fault of the other Party, (iii) is disclosed under force of law, applicable regulation, governmental regulation or court order, or (iv) is required to be disclosed by a banking partner, an Acquirer or an applicable Payment Network.

• AGENCY agrees FORTE will not be held responsible for any losses, directly or indirectly, incurred by AGENCY or other third parties as a result of XXXXX'x failure to accomplish the request before the Transaction has been processed through the applicable Payment Network or for making any necessary changes as requested by Agency.

• AGENCY acknowledges and expressly authorizes FORTE, in compliance with Payment Network Rules, to provide to the Payment Networks and applicable regulatory bodies, AGENCY’s name and contact information as well as Transaction details should AGENCY’s chargeback ratio exceed the allowable limits in any given period.

Payment Network means any Credit Card Association, electronic funds transfer network, electronic check services association or automated clearing house association, governmental agency or authority, and any other entity or association that issues or sponsors a Payment Device or operates a network on which a Payment Device is processed.

Payment Network means Visa, MasterCard (including Maestro), American Express, Diners Club International, Discover, JCB, China Unionpay and any other card scheme We approve for card payment acquiring, and (in relation to direct debits) BACS, and (in relation to Alternative Payment Scheme Transactions) any Alternative Payment Scheme; Payment Network Rules means the set of bylaws, rules, regulations, operating regulations, procedures and waivers issued by (or formed in relation to) a Payment Network, including any amendment, addition or replacement over time and, in relation to BACS, the BACS Rules; PSRs means the Payment Services Regulations 2017; Restricted Person means any person that is listed on (or owned or controlled by a person listed on) any Sanctions List or is otherwise a target of any Sanctions; and or any persons, countries and/or organisations prescribed by OFAC regulations and United Nations Sanctions, European Union Sanctions Lists and other applicable country financial sanctions from time to time; Sanctions means any economic sanctions laws, regulations, embargoes or restrictive measures imposed by the authorities at any time in the United States, the United Nations, the European Union and/or the United Kingdom, including without limitation, the Office of Foreign Assets Control of the US Department of Treasury, the United States Department of State, and Her Majesty’s Treasuries; Sanctions List means the “Specifically Designated Nationals and Blocked Persons” list issued by the Office of Foreign Assets Control of the US Treasury, the “Consolidated List of Financial Sanction Targets” issued by Her Majesty’s Treasury or other list issued or maintained by the authorities in the United States, the United Nations, the European Union and/or the United Kingdom; Services means, as applicable, the services to be provided by Us in relation to a relevant Access Payment Product and as set out in Statements of Work; Specification means (if any) each specification for the Access Payment Product(s) as set out in the relevant Documentation and/or the Statement of Work; Statement(s) of Work means each statement of work specifying the Access Payment Product(s) to be supplied under this Agreement which incorporate these Terms and Conditions. For the avoidance of doubt, an order form signed by You will be a Statement of Work for the purposes of this Agreement; Terms and Conditions means these terms and conditions;

Payment Network means Visa, MasterCard and any credit or debit card network issuing credit or debit cards and/or their duly authorized entities, agents or affiliates.
