Accordingly, any Related Dispute will be determined subject to and in accordance with the terms of Sections 9.4.2 to 9.4.4 above.
In the event that the Dispute is consolidated with any Related Dispute the Expert shall reach a decision on (and the Disputing Parties shall attempt to resolve) the Dispute and any Related Dispute at the same time.
In the event of the Expert ordering consolidation of the Dispute and the Related Dispute in accordance with Section 9.5.2, the Expert shall have the authority and power to direct that all matters arising in both the Dispute and the Related Dispute are consolidated in whatever manner the Expert determines and the Disputing Parties shall thereafter abide by and implement such consolidation and any such direction.
Within ten (10) Business Days of receiving the request referred to in section17.7.2, the first arbitration tribunal appointed in respect of any Related Dispute may, if it considers it appropriate, order consolidation some or all of the Related Disputes and shall in such circumstances have the authority and power referred to in Section 17.7.4. Any dispute between arbitration tribunals shall be referred to the LCIA for resolution.
If a Dispute has been referred to an arbitration tribunal pursuant to Section17.3 and a Related Dispute has also been so referred to an arbitration tribunal for determination any Disputing Party or the Market Operator may request the relevant arbitration tribunals to consolidate the Related Disputes.
