Trust Deed definition

Trust Deed means the Trust Deed dated December 9, 2002 of UTI Mutual Fund.

Trust Deed or “Deed” means the Trust Deed of the Fund executed between the Management Company and the Trustee along with all the exhibits appended hereto.

Trust Deed means the deed dated 20 February 1985 made between the Trustee and the Manager constituting the Burswood Property Trust as amended consolidated and replaced by a deed dated 18 April 1985 made between the Trustee and the Manager and includes such last mentioned deed as thereafter from time to time altered or amended with the prior approval of the Minister;

• All references in this Agreement to an agreement, instrument or other document (including the Trust Deed) shall be construed as a reference to that agreement, instrument or other document as the same may be amended, supplemented, replaced or novated from time to time.

• The Registrar shall, at the request of the Holder of any Note held through DTC, issue Forms of Proxy and Block Voting Instructions in a form and manner which comply with the provisions of Schedule 4 (Provisions for Meetings of Noteholders) to the Trust Deed (except that it shall not be required to issue the same less than forty-eight hours before the time fixed for any Meeting therein provided for).

• In the case of any default by the Issuer or the Guarantor, no Agent shall have any duty or responsibility in the performance of the Issuer’s or the Guarantor’s obligations under this Agreement, the Conditions or the Trust Deed.

• The schedules are part of this Trust Deed and shall have effect accordingly.
