Work Commitment Guarantee. 1. Following the end of each calendar year, the Right Holders may present to the Minister, with a copy to the Petroleum Administration, a statement of the Recoverable Costs they incurred in fulfilment of the Minimum Work Commitment during such calendar year. Within thirty (30) days after the receipt of such statement, the Minister, based on the recommendation of the Petroleum Administration, shall provide to the Right Holders a certificate (in the form attached to the Work Commitment Guarantee) providing for the reduction of the amount of the Work Commitment Guarantee in the amount of the Recoverable Costs set forth in the statement. In the event that the Minister, based on the recommendation of the Petroleum Administration, disputes the amount of any such Recoverable Costs, or their allocation to the Minimum Work Commitment, the Minister shall provide a certificate with respect to the undisputed portion thereof. The Petroleum Administration and the Right Holders shall discuss the resolution of such dispute, and if no agreement is reached within thirty (30) days of the date of delivery of such statement, the Right Holders may submit the question to a sole expert for determination pursuant to Article 39 of this EPA.
