Common use of 2002 Master Agreement Protocol Clause in Contracts

2002 Master Agreement Protocol. The parties agree that, with effect on and from the date of this Agreement the terms of each Annex to the 2002 Master Agreement Protocol, as published by ISDA on 15 July 2003 and available on the ISDA website (xxx.xxxx.xxx) (the “2002 Protocol”) and the definitions included in Part 6 of the 2002 Protocol will apply to this Agreement as if the Annex and the definitions were reproduced in full in this Agreement. References in the 2002 Protocol to a 2002 Master shall be deemed to be a reference to this Agreement.

The parties agree that, with effect on that the definitions and from provisions of the date of this Agreement the terms of each Annex to the ISDA 2002 Master Agreement Protocol, Protocol as published by ISDA on 15 July 15, 2003 and available on the ISDA website (xxx.xxxx.xxx) (the “2002 Protocol”) are incorporated into and the definitions included in Part 6 of the 2002 Protocol will apply to this Agreement as if the Annex and the definitions were reproduced set out in full herein, for the purpose of indicating agreement by the parties to the amendments set out in this AgreementAnnexes 1 to 18 of the Protocol. References in the 2002 Protocol to a 2002 Master shall be deemed to be a reference references to this Agreement.

As used in this Agreement (including in all Confirmations related to it), any reference to any ISDA Definitions Booklet and/or Credit Support Provisions shall mean that ISDA Definitions Booklet and/or those Credit Support Provisions as deemed amended in accordance with the definitions included in Part 6 terms of the 2002 Protocol will apply to this Agreement as if the Annex and the definitions were reproduced in full in this Agreement. References in the 2002 Protocol to a 2002 Master shall be deemed to be a reference to this AgreementProtocol.

References In this respect, references in the 2002 Protocol to a an “ISDA 2002 Master shall Agreement” will be deemed to be a reference references to this Agreement.Agreement and the term “the parties”, as used in the Protocol shall be construed as referring to Party A and Party B.
