2018 Stock Incentive Plan. The Original Option Agreement was granted under the EVO Transportation & Energy Services, Inc. Amended and Restated 2018 Stock Incentive Plan. This Amended Option Agreement, however, is not governed by or subject to the terms of the EVO Transportation & Energy Services, Inc. Amended and Restated 2018 Stock Incentive Plan. By the Optionee’s signature and the signature of the Company’s representative below, the Optionee and the Company agree that this Amended Option is granted under and governed by the terms and conditions of this Amended Option Agreement. The Optionee has reviewed this Amended Option Agreement in their entirety, has had an opportunity to obtain the advice of counsel prior to executing this Amended Option Agreement and fully understands all provisions of the Amended Option Agreement.
