Common use of 3Attorneys’ Fees Clause in Contracts

3Attorneys’ Fees. In any proceeding brought to enforce this Agreement or because of the breach by any Party of any covenant or condition herein contained, the prevailing Party shall be entitled to reasonable attorneys’ fees (including reasonably allocated fees of in-house counsel) in addition to court costs and any and all other costs recoverable in said action.

3Attorneys’ Fees. In If any action at law or in equity is necessary to enforce or interpret the terms of this Agreement, including any proceeding brought to enforce this Agreement or because of the breach by any Party of any covenant or condition herein containedunder Section 6.4, the prevailing Party party shall be entitled to reasonable attorneys’ fees (including reasonably allocated fees of in-house counsel) fees, costs and necessary disbursements in addition to court costs and any and all other costs recoverable in said actionrelief to which such party may be entitled.
