Common use of 42 C.F.R. Part 2 Compliance Clause in Contracts

42 C.F.R. Part 2 Compliance. If you (a) qualify as a substance use disorder “program” as defined in 42 C.F.R. § 2.11, (b) receive, store, process, have access to, maintain, or otherwise deal with “patient identifying information” or “records” as defined in 42 C.F.R. § 2.11, and (c) are “federally assisted” as defined in 42 C.F.R. § 2.11, you acknowledge and agree that you are fully bound by and will fully comply with the federal regulations governing Confidentiality of Substance Use Disorder Patient Records, 42 C.F.R. Part 2, with respect to such information and records, including but not limited to the provisions related to use, disclosure, and re-disclosure thereof.
