6Bankruptcy Clause Samples

The Bankruptcy clause outlines the rights and obligations of the parties in the event that one party becomes insolvent or files for bankruptcy. Typically, this clause allows the non-bankrupt party to terminate the agreement or suspend performance if the other party is subject to bankruptcy proceedings, and may specify notification requirements or the treatment of outstanding obligations. Its core function is to protect parties from the risks associated with continuing a contractual relationship with an insolvent counterparty, ensuring that they are not unfairly disadvantaged by the other party's financial distress.
