A waiver of Partnership. Enforcement Events under the Limited Partnership Agreement by the Property Trustee at the direction of the Holders constitutes a waiver of the corresponding Trust Enforcement Event under this Trust Agreement. The foregoing provisions of this Section 2.06(c) shall be in lieu of Section 316(a)(1)(B) of the Trust Indenture Act and such Section 316(a)(1)(B) of the Trust Indenture Act is hereby expressly excluded from this Trust Agreement and the Preferred Trust Securities, as permitted by the Trust Indenture Act.
