Abandonment Default. The Company shall have ceased to carry on its business; or the Project shall have been abandoned by the Company; or, following the Project Completion Date, the operation of the Project shall have been interrupted for a period in excess of 90 Omolon - 70 - OPIC Finance Agreement consecutive days or any periods in the aggregate in excess of 120 days during any period of 12 consecutive months.

In such an event, the Landlord may dispose of all Resident’s property remaining on said premises in a manner consistent with the prevailing Landlord/Tenant law and re-rent said premises. Furthermore, in the event rent is fully paid, the absence of a Resident from the premises for more than thirty (30) consecutive days or absence from the premises for more than sixty (60) days during a calendar year shall be grounds for termination of this Lease Agreement (unless Landlord agrees in writing to an exception to this requirement).

Abandonment Default. Lessee shall not vacate or abandon the Property at any time during the term of this Agreement. In the event of any breach by Lessee of this Agreement, in addition to other rights and remedies available at law or in equity, Lessor shall have the option immediately to terminate this Agreement and all rights of Lessee hereunder by giving written notice of termination. In the event Lessor elects to so terminate this Agreement, Lessor may recover from Lessee all amounts of unpaid rents for the entire term, less any amounts received by Lessor for the re-letting of the Property. In the event Lessee vacates or abandons the Property or otherwise breaches this Agreement, Lessor may from time to time, without terminating this Agreement, either recover all rents as they become due or re-let the Property or any part thereof upon such terms and conditions as Lessor deems appropriate.
