Common use of Abandonment of Premises Clause in Contracts

Abandonment of Premises. Tenant agrees not to abandon or vacate the Premises during the Term of this Lease. If Tenant does abandon or vacate the Premises for more than ninety (90) days, Landlord may terminate this Lease, by written notice to Tenant at any time prior to Tenant reoccupying the Premises, but such termination shall not entitle Landlord to pursue any other remedies unless an uncured Event of Default then exists, in which case Landlord may pursue any and all remedies provided by this Lease, at law or in equity.

If Tenant agrees not to abandon vacates or vacate abandons all or a material portion of the Premises during (even if Tenant continues to pay Rent) and does not resume occupancy of the Term entire Premises within six (6) months thereafter, then Landlord may elect to terminate this Lease as to the vacated or abandoned portion of this Lease. If Tenant does abandon or vacate the Premises for more than ninety (90) days, Landlord may terminate this Lease, by giving Tenant written notice to Tenant at any time prior to Tenant reoccupying the Premisesof such termination, but and such termination shall not entitle Landlord to pursue any other remedies unless an uncured Event of Default then exists, in which case Landlord may pursue any and all remedies provided by this Lease, at law or in equitybe effective sixty (60) days thereafter.
