Ability to Perform Duties Clause Samples
The "Ability to Perform Duties" clause establishes that a party, typically an employee or contractor, must be physically and legally capable of fulfilling the responsibilities outlined in their agreement. In practice, this clause may require the individual to confirm they have the necessary qualifications, health, and legal status to perform their job functions, such as holding required licenses or being free from any restrictions that would impede their work. Its core function is to ensure that the party can meet their obligations under the contract, thereby protecting the other party from disruptions or liabilities arising from incapacity or ineligibility.
