Common use of Acceptance of Rent Clause in Contracts

Acceptance of Rent. If this Sublease is assigned, whether or not in violation of the provisions of this Sublease, Sublandlord may collect rent from the assignee. If all or any part of the Premises are sublet, whether or not in violation of this Sublease, Sublandlord may, after default by Subtenant and expiration of Subtenant's time to cure such default, collect rent from the subtenant. In either event, Sublandlord may apply the net amount collected to payment of Rents, but no such assignment, subletting, or collection shall be deemed a waiver of any of the provisions of this Article, an acceptance of the assignee or subtenant as a lessee, or a release of Subtenant from the performance by Subtenant of Subtenant's obligations under this Sublease.

In either event, Sublandlord Landlord may apply the net amount collected to payment of RentsBasic Rent, Escalation Charges and other charges due in respect of this Lease, but no such assignment, subletting, or collection shall be deemed a waiver of any of the provisions of this Article, an acceptance of the assignee or subtenant as a lessee, or a release of Subtenant Tenant from the performance by Subtenant Tenant of SubtenantTenant's covenants and obligations under this SubleaseLease.
