Common use of Acceptance; Rejection Clause in Contracts

Acceptance; Rejection. A holder of Notes may accept or reject the offer to prepay made pursuant to this Section 8.3 by causing a notice of such acceptance or rejection to be delivered to the Company on or before the date specified in the certificate described in paragraph (g) of this Section 8.3. A failure by a holder of Notes to respond to an offer to prepay made pursuant to this Section 8.3, or to accept an offer as to all of the Notes held by the holder, within such time period shall be deemed to constitute rejection of such offer by such holder.

A holder of Notes may accept or reject the offer to prepay made pursuant to this Section 8.3 by causing a notice of such acceptance or rejection to be delivered to the Company on or before the date specified in the certificate described in paragraph (ge) of this Section 8.3. A failure by a holder of Notes to respond to an offer to prepay made pursuant to this Section 8.3, or to accept an offer as to all of the Notes held by the holder, within such time period shall be deemed to constitute rejection of such offer by such holder.

A failure by a holder of Notes to respond to an offer to prepay made pursuant to this Section 8.38.7, or to accept an offer as to all of the Notes held by the holder, within such time period shall be deemed to constitute rejection acceptance of such offer by such holder.

A holder of Notes Noteholder may accept or reject the offer to prepay made pursuant to this Section 8.3 by causing a notice of such acceptance or rejection to be delivered to the Company on or before the date specified in the an officer’s certificate described in pursuant to paragraph (gg)(vii) of this Section 8.3. A failure by a holder of Notes Noteholder to respond to an offer to prepay made pursuant to this Section 8.3, or to accept an offer as to all of the Notes held by the holder, within such time period shall be deemed to constitute rejection of such offer by such holder.

A holder of Notes Noteholder may accept or reject the offer to prepay made pursuant to this Section 8.3 8.4 by causing a notice of such acceptance or rejection to be delivered to the Company on or before the date specified in the an officer’s certificate described in pursuant to paragraph (gg)(vii) of this Section 8.38.4. A failure by a holder of Notes Noteholder to respond to an offer to prepay made pursuant to this Section 8.38.4, or to accept an offer as to all of the Notes held by the holdersuch offer, within such time period shall be deemed to constitute rejection of such offer in its totality by such holderNoteholder. Any Noteholder that accepts such offer shall be deemed to have agreed to the prepayment of Notes in accordance with the following clause (e).
