Access Programming Support Not Franchise Fees. Grantee agrees that capital support for Access Programming costs set forth in Section 9.2 shall in no way modify or otherwise affect Grantee's obligations to pay Franchise Fees to the Town. ▇▇▇▇▇▇▇ agrees that although the sum of Franchise Fees plus the payments set forth in Section 9.2 may total more than five percent (5%) of Grantee's Gross Revenues in any 12-month period, the Grant shall not be offset or otherwise credited in any way against any Franchise Fee payments under this Franchise Agreement so long as such support is used for capital related to Access Programming purposes.
