Access to establishments Clause Samples
The 'Access to establishments' clause grants certain parties, such as inspectors, contractors, or representatives, the right to enter specific premises or facilities for defined purposes. Typically, this access is provided to allow for inspections, maintenance, audits, or the delivery of goods and services, and may be subject to advance notice, security protocols, or time restrictions. The core function of this clause is to ensure that authorized individuals can perform necessary tasks on-site, thereby facilitating compliance, oversight, or operational efficiency while maintaining clear boundaries and expectations regarding entry.
Access to establishments. (1) Upon request by the Council or by a trade union party that represents the majority of employees in a workplace, the employer must permit duly authorized representatives, agents, officers, trainers or presenters of service providers, access to the premises for the purposes of conducting awareness and education programmes.
(2) An employer may make any access subject to any conditions as to time and place that are reasonable and necessary to safeguard life or property or prevent undue disruption of work.
Access to establishments. 56.1. The End User Establishment shall have the right to refuse access to its establishment at any time to any individual employee of the contractor or to any agent of the contractor. The exercise of this right shall not diminish the contractor's obligation to perform the service, provided that the End User Establishment can give the contractor additional access to the said establishment at times sufficient to enable the contractor to fulfil his obligations under the End User Agreement.
56.2. The contractor shall afford all reasonable facilities to any other contractors employed by the End User Establishment, to any employees of the End User Establishment and to any other person or persons duly authorised to be on the establishment to enable them to go about their lawful business on the establishments. The contractor shall not deny access to the establishment to any such person.
56.3. Whilst work operations are being carried out within the establishment, the contractor's staff in the absence of the User establishment shall be responsible for ensuring that reasonable precautions are taken to prevent unauthorised access to the establishment, rooms or other areas. The Contractor or his employees shall report the presence of any unauthorised person to the user establishment and where practical, deny access to the same.
56.4. Unauthorised persons for the purpose of this clause are defined as any person for whom the contractor has not received notification (verbal or written) from the user establishment that those persons have been authorised to be present at the establishment. Notices relating to authorised persons may be entered in the establishment record book by the user establishment.
56.5. The contractor shall not allow employees of the contractor or sub contractors to permit the entry to the establishment by children other than with the express permission of the User establishment at any time and shall not employ or allow any person under the age of 16 years to carry out work on the service at any time during the framework agreement period. 60.1. The contractor at all times shall comply with the Health and Safety at Work Act 1974 and of any other acts, regulations or orders pertaining to the health and safety of employees.
Access to establishments. 5.1 In the matter of 3.1.2 (vi), the Commission will arrange in advance access to Defence establishments through the applicable establishment’s security office. The designated Department primary point of contact will make every reasonable effort to resolve an access issue.
5.2 In the matter of 3.1.2 (iii) and 3.2.2 (i), the Department or Commission will arrange in advance access to the Department’s or Commission’s laboratory capabilities and use of the laboratory facilities and services through the appropriate designated primary point of contact. The designated primary point of contact will make every reasonable effort to resolve an access issue.
