Common use of Access to List of Owners' Names and Addresses Clause in Contracts

Access to List of Owners' Names and Addresses. The Certificate Registrar shall furnish or cause to be furnished to the Master Servicer, the Servicer, the Depositor and the Indenture Trustee within 15 days after receipt by the Owner Trustee of a request therefor from the Master Servicer, the Servicer, the Depositor, or the Indenture Trustee in writing, a list, in such form as the Master Servicer, the Servicer, the Depositor or the Indenture Trustee may reasonably require, of the names and addresses of the Owners as of the most recent Record Date. If three or more Certificateholders together evidencing not less than a 25% Percentage Interest in the Certificates apply in writing to the Owner Trustee, and such application states that the applicants desire to communicate with other Certificateholders with respect to their rights under this Agreement or under the Certificates and such application is accompanied by a copy of the communication that such applicants propose to transmit, then the Owner Trustee shall, within five Business Days after the receipt of such application, afford such applicants access during normal business hours to the current list of Certificateholders. Each Owner, by receiving and holding a Certificate, shall be deemed to have agreed not to hold any of the Depositor, the Company, the Certificate Registrar or the Owner Trustee accountable by reason of the disclosure of its name and address, regardless of the source from which such information was derived.
