Common use of Access to Private Keys Clause in Contracts

Access to Private Keys. Equity Tokens purchased by Purchaser may be held by Purchaser in Purchaser’s digital wallet or vault, which requires a private key, or a combination of private keys, for access. Accordingly, loss of requisite private key(s) associated with Purchaser’s digital wallet or vault storing Equity Tokens will result in loss of such Equity Tokens, access to Purchaser’s Equity Token balance and/or any initial balances in blockchains created by third parties. Moreover, any third party that gains access to such private key(s), including by gaining access to login credentials of a hosted wallet or vault service Purchaser uses, may be able to misappropriate Purchaser’s Equity Tokens. Company is not responsible for any such losses.

Access to Private Keys. Equity Stacks Tokens purchased by Purchaser may be held by Purchaser in Purchaser’s digital wallet or vault, which requires a private key, or a combination of private keys, for access. Accordingly, loss of requisite private key(s) associated with Purchaser’s digital wallet or vault storing Equity Stacks Tokens will result in loss of such Equity Stacks Tokens, access to Purchaser’s Equity Blockstack Token balance and/or any initial balances in blockchains created by third parties. Moreover, any third party that gains access to such private key(s), including by gaining access to login credentials of a hosted wallet or vault service Purchaser uses, may be able to misappropriate Purchaser’s Equity Stacks Tokens. Company is not responsible for any such losses.

Equity Upthinity Tokens purchased received by Purchaser Buyer may be held by Purchaser Buyer in Purchaser’s Buyer's digital wallet or vault, which requires a private key, or a combination of private keys, for access. Accordingly, loss of requisite private key(s) associated with Purchaser’s Buyer's digital wallet or vault storing Equity Upthinity Tokens will result in loss of such Equity Upthinity Tokens, access to Purchaser’s Equity Buyer's Upthinity Token balance and/or any initial balances in blockchains created by third parties. Moreover, any third party that gains access to such private key(s), including by gaining access to login credentials of a hosted wallet or vault service Purchaser Buyer uses, may be able to misappropriate Purchaser’s Equity Buyer's Upthinity Tokens. Company is not responsible for any such losses.

Accordingly, loss of requisite private key(s) associated with PurchaserBuyer’s digital wallet or vault storing Equity BULK TRADER Tokens will result in loss of such Equity BULK TRADER Tokens, access to PurchaserBuyer’s Equity BULK TRADER Token balance and/or any initial balances in blockchains created by third parties. Moreover, any third party that gains access to such private key(s), including by gaining access to login credentials of a hosted wallet or vault service Purchaser Buyer uses, may be able to misappropriate PurchaserBuyer’s Equity BULK TRADER Tokens. Company is not responsible for any such losses.
