Accrued and Unused Vacation. The Company will pay Employee $81,826.92 (gross), less applicable federal, state and local withholding and other legally required withholdings, for Employee’s accrued and unused vacation (as verified in the Company’s audited financial records) on the first payday after 20 days have passed from the date Employee signs and returns this Agreement to the Company.

Accrued and Unused Vacation. The Hired Active Employees may take any vacation time accrued for the 2004 calendar year either before or after the Closing pursuant to Seller's vacation policies.
